“A former hospice worker was placed on 20 years of supervised probation and two years of work release after pleading guilty to sexually assaulting a blind, deaf and nearly comatose 10-year-old girl with a terminal illness. James Ernest Philpott, 55, apologized to the girl’s family before his sentencing. He had pleaded guilty to one count of sexual assault on a child by a person in a position of trust. Police said Philpott told investigators he had sex with the girl because he wanted her to experience pleasure before she died. A licensed practical nurse, Philpott worked at the Hospice of St. John in Lakewood, Colo., at the time. Philpott was arrested in 2004 after he allegedly told co-workers that he had sex with a 10-year-old girl and an 89-year-old woman at the hospice. During a phone conversation with a co-worker, he allegedly said the girl ‘was fun but the (elderly woman) was funner.’ Charges were dismissed involving the elderly woman because she had dementia and wasn’t sure whether the assault was real or a dream. Certainly it’s difficult to put any credence whatsoever into Mr. Philpott’s excuse that he was nobly bestowing pleasure on the dying young girl. In the first place, as a nurse he should have realized that stimulating a girl who was “prone to seizures when excited” was probably not a good idea. In the second place, his motivation loses its altruism when he’s telling coworkers that raping a kid is “fun” but raping an 89-year-old is “funner.” And in the third place, according to another article, Mr. Philpott “had a 20-year history of making obscene phone calls, who had sex with numerous prostitutes and strangers, owned more than 700 pornographic movies, and stored child pornography images on his computer.”

It’s not illegal to own pornographic movies or to have sex with strangers — but wait a minute. Prosecutors knew that this guy had kiddie porn on his computer? Contemplate that for a minute. Mr. Philpott received a twenty-year sentence which was immmediately suspended by the judge in favor of work release and probation. He had a history of deviant behavior. He possessed kiddie porn. He raped two people. (Were there more? He was in a position to exploit people who couldn’t or wouldn’t know enough to report him.) Does that punishment seem mild to anyone else? Most people get worse just for possession of child pornography. This guy committed a worse crime and pretty much walked free. It sure makes you wonder about that judge.
