Lowering the Age of Consent in the Czech Republic

“Sexual intercourse in the Czech Republic will probably become legal as of the age of 14 instead of current 15, under the draft Penal Code that the lower house passed today and which is yet to be discussed by the Senate. The bill not only lowers the age limit for criminal liability from 15 to 14, but also lowers the age limit for legal sex accordingly. At present, it is unlawful to have sex with a person aged under 15. In the parliamentary debate, deputies pointed to the connection between the criminal liability age limit and the age limit for sexual intercourse. ‘People grow adult earlier in social, psychological as well as bodily terms, therefore the lowering of the age limit by one year is appropriate,’ Jiri Pospisil, senior opposition Civic Democrats’ (ODS) shadow justice minister, told CTK today. According to a poll conducted last year, 15 percent of the 9th grade pupils, i.e children aged 15-16, said they already had sex. Most of them said they had first sex at the age of 14, one in ten even at the age of 13.” — Czech News Agency (Czech Republic)

Such a bill would undoubtedly be more controversial in the United States, where anything touching on the sexuality of teenagers is fraught with high emotion, than it will be in the Czech Republic. You could look at this cynically, considering that Eastern Europe is the source for a fair amount of child pornography. Or you could look at it as an act of enlightenment, one which adjusts the legal reality to the fact that fourteen-year-olds are physically equipped for sex and not infrequently putting that equipment to use.

Or you could also take a look at the matter psychoanalytically. Freud once made the argument that sexual perversions often result from a person basically getting stuck at some level of pre-pubescent autoerotic stimulation. For example, if a child learns to derive pleasure from some relatively non-sexual source, like angora sweaters, he might well find it difficult to renounce this pleasure later in life. In consequence, in the stead of a developed “adult” sexuality, he ends up with an angora fetish, like the director Ed Wood.

If you’ve read your Freud, then arguments about age of consent laws might bring this theory to mind. Why? Because the theory basically implies that the longer sexual relations are postponed, the more likely it is that “defects” such as perversions and fetishes arise. Weirdly, then, raising age of consent laws might have the entirely unintended effect of creating more perverts, and lowering them might well accomplish the reverse.
