The statutes he was convicted under, forced labor and sex trafficking, seem
to have been originally intended to apply to women and men (usually immigrants)
who were smuggled into the nation and forced to labor in a variety of ways.
The women and men often are told they will be deported if they complain, and
are often beaten, blackmailed, and threatened to get them to remain. The statute
was never meant to cover a BDSM relationship.

As for the allegations of abuse, I feel if the govt was REALLY after an
abusive man (which Glenn is not), Glenn would have been charged with assault,
aggravated assault, domestic violence, battery, and rape. But he was not. And the
reason for that (at least my view of it) is explained below.

This is, as far as I know, the first time these statutes have been used in
this way. As a result of this conviction, now almost anything can be “forced
labor”. I believe thats what the Government wants, an expansion of their powers.
The prosecutor stated in response to a jury question that if someone forced
someone to play tiddlywinks, that could be forced labor. That certainly paves
the way for the Government to prosecute ANY BDSM relationship, or any divorce
where a woman (or a man) claims the other made them cook, wash dishes, do
housework, etc. Certainly where someone is called a slave, the government will be
more eager to say “see, it IS slave labor”. The government will conviently
ignore the fact its not actual slavery, but an aggreed upon structure by both
parties.

This prosecution is a threat to BDSM. And whether you loathe Glenn or love
him, he needs support or else we shall all suffer the effects of this horrid
precedence setting case.

Faces life sentence.March 6, 2007 — A man who tortured a “sex slave” then forced her to maintain a Web site filled with depraved images of her bleeding and bruised body was convicted of sex trafficking and forced labor yesterday in Brooklyn federal court.

Glenn Marcus – who sources said turned down a plea deal for no jail time – faces up to life in prison for the crimes.

A seven-man, five-woman jury deliberated for seven days before finding Marcus, 53, guilty of the two charges. They acquitted him of an obscenity charge he faced stemming from the graphic images depicted on his slavespace.com Web site.

Marcus, a chubby, balding man with thick glasses, showed no emotion as the jury forewoman read the verdict.

After the jury left the courtroom, Marcus spoke to a meek-looking woman in the courtroom who sources said was one of his current “slaves.” He told her: “It’s a victory in one sense,” apparently in reference to the acquittal on the obscenity charge. Friends say Marcus refused the plea deal because he saw his case as a First Amendment issue.

He will remain out on $1 million bail until his sentencing.

The letter acknowledges that the case against Marcus may actually pose a danger to the sexual freedom of BDSMers. . .

An excerpt from a Government letter dated 10/27/2006, available from public records:

The limited protections requested by the government are
necessary and appropriate to protect the witnesses’ safety and well-being, avoid potential harassment of the witnesses by the press and others, and prevent undue embarrassment and other adverse consequences, such as loss of employment.

In addition, Marcus’s arrest and prosecution has prompted heated debate online among members of the BDSM community and others, some of whom see the government’s prosecution as oppressive and a threat to their sexual freedom. These individuals could similarly view the witnesses’ testimony for the government as offensive and wrong, which could lead to retaliation against the witnesses. [boldface added by poster]

To answer the questions..nothing has changed..nearly a year later and He is still under house arrest.
