Schwarzenegger Outlaws Sex with Corpses
“Having sex with corpses is now officially illegal in California after Governor Arnold Schwarzenegger signed a bill barring necrophilia, a spokeswoman says. The new legislation marks the culmination of a two-year drive to outlaw necrophilia in the state and will help prosecutors who have been stymied by the lack of an official ban on the practice, according to experts. ‘Nobody knows the full extent of the problem. … But a handful of instances over the past decade is frequent enough to have a bill concerning it,’ said Tyler Ochoa, a professor at Santa Clara University School of Law who has studied California cases involving allegations of necrophilia. ‘Prosecutors didn’t have anything to charge these people with other than breaking and entering. It’s funny how the newspaper headline says that Schwarzenegger outlaws sex with corpses, rather than saying California outlaws it. You’d think the “governator” had done some heroic deed, pummeling pro-necrophilia forces into submission. Really the law had already been in the making for several years, in large part thanks to two recent cases — one in which the cadaver of a little girl was victimized, and another in which a drunk was found in a funeral home sleeping on top of some old lady’s stiff.
That being said, how do lawmakers determine an appropriate prison sentence for something like this? After all, who’s the victim exactly? How does the victim suffer? What rights does a dead body have? Can you really rape something that has no will to resist? These are tricky questions, and it really makes you wonder how lawmakers decide that “up to eight years” is the appropriate prison sentence for necrophilia. There are guys who get fewer years for raping children, and there are dumb teenagers who get more years for selling pot. So what’s the legal principle behind these punishments? Obviously it can’t be “eye for an eye,” since what do you do to somebody who rapes your dead grandmother — do you rape his dead grandmother too? But then, who would you enlist to do that?
Is there any truth to the rumor that one of the defiled dead corpses was named Gray Davis?

I hope that would not be the solution. Anyway, lets say somebody has his way with your dead daughter’s cadaver. Wouldn’t you feel disrespected and want that person punished? Not that SEVERELY but to the extent of what he/she deserves. Come on now where is your morals and common sense. You can’t turn the other cheek.

It is unappropriate and disgusting to pick your nose in public. Why not make that punishable with 8 yrs. behind bars too? Not everything that we find disgusting, perverted or offensive should be illegal. A fine payable to the family would be appropriate.

i cant see how consent can be considered in a case such as this, how can a corpse consent to anything. i do think it should be illegal. if we judge that society has the right to make laws concering individual actions, which it does, then surely it should be allowed to legislate in areas concerning sex with a corpse. it can not be considered rape. The idea of relating having sex with a corpse to that of picking your nose seems stupid, there is a total difference. anyway, strange subject!
I think necrophilia should be legal, I my-self have a strong necro sexual fetish. I find a law against necrophilia a law made merely by close minded people who are not able to except that a corpse can actaully be a very erotic thing indeed. Call me sick if you want, but I find this law to be in many cases to be a mere ploy by social conservatives who are threatened by people such as my-self because they are unable to expect anything different from what socities current standards of conducy may be.

Ok,I can understand the reason behind banning necrophilia: How would you feel if it was a relative of yours? I’d be pissed off. But at the same time 8 yrs in jail? unless the person commiting the act killed first no jail time is necessary. Politics is dumb, just like the “war on terrorism” You can’t fight terrorism anymore then fighting necrophilia, its a part of society whether people like it or not. I don’t think therapy can help a necrophile because its what they prefer.
necrophilia is a disgusting perverted and unatural act but its hardly what you call a sex crime, considering the fact that a dead person can not have any harm done to them, but i still think that necrophilia should be outlawed because its a perverted indecent act which doesnt involve any consent, any sexual act which does not involve consent between mature people or adults should remain outlawed, and necrophilia is also a very unhealthy and unclean sexual practice because corpses rot and decay and they trigger all kinds of deseases so a person who engages in such activity is putting there physical health at risk.
Is necrophilia defined as obtaining sexual gratification through physical contact with a dead human being? Is this the crime in CA? Or do you have to engage in genital contact with the corpse. In any event, I think that it is reasonable for society to determine that it should be illegal to desecrate a deceased human being, which is the essence of this law. I frankly would have imagined that desecrating a corpse or grave was already a crime in CA. Other unhealthy sexual practices are not illegal, so I doubt that is the point… Imagine being sent to prison for eight years for necrophilia, and the other inmates find out what you are in for. Would they stay far away from you, or give you extra trouble?

firstly, i don’t have any sexual fetishes for the dead, and i think necrophilia is wrong in every way to some extent, but i also wonder, what makes these politicians think they have the right to control someones feelings, and suppress them, thats exactly what there doing, being gay is legal, thats a fairly odd sexual/love based scenario, so why arent the laws against necrophilia, at least, slackened off abit, homosexuals/necrophiliacs/celebacy, there all human emotions and thought process’s. what about all these people who masturbate over marilyn monroe, and say, oh well she is a sex symbol, or, she was a sex symbol, she IS STILL DEAD, however you look at it.
