What Is Rape?

In India feminist groups have been trying to enlarge the definition of rape. Hitherto it has been reserved exclusively for forcible penile/vaginal penetration, and these advocacy groups would simply like it expanded to include other sorts of violation. It’s not at all an instance of feminist hysteria or libertarian melodrama. These groups aren’t asking for a pinch on the bum or a lewd stare to be considered rape. They’re just requesting that, if a guy shoves a wooden spoon up a girl’s ass, it be considered as much an act of rape as if he had shoved his penis into her vagina.
It sounds like a pretty reasonable proposal, at least from this side of the world. So why did the judge shoot it down? He seemed to have two reasons. The first was legal precedent — the definition hadn’t been changed in a century, so why change it now? Of course this is precisely the same reason these advocacy groups wanted the definition changed. Since the definition was a century old, it didn’t seem consonant with contemporary mores.
And the second reason? Changing the definition of rape, the judge argued, would “result in a good deal of chaos and confusion.” Hunh? What kind of confusion and chaos — among rapers? Like, a guy wants to rape a girl who’s been refusing his advances, but he’s not sure what constitutes rape anymore? He doesn’t know whether to fuck her or poke her with a stick, so he’s crippled by indecision, like Hamlet?
it’s such a bizarre rationale that it makes it difficult not to think that the judge is just worried about increasing his case load. To expand the definition of a crime is to invite more litigation. “Who needs it?” he must have thought to himself. “All these women do nothing but complain anyway. Why give ‘em another legitimate beef?”
Believe it or not, the term of rape in the UK still only applies to forced penetration of the vagina. Anything else is sexual assault and generally carries a lesser sentence.
In the UK a rape victim is often aggressivly cross examined by the defence team and challenged about her previous sexual history, what clothes she wears and even what underwear she buys, in order to demonstrate to the jury that she must be some kind of wanton slut who was gagging for it.
Mind you on the other side of the fence the accused can be named and in the press (John Lesley a TV presenter had this going on) whilst the accuser remains anonymous. Weird stuff
There’s considerable latitude in what’s considered rape in the US. The Oregonian recently came under fire when it charactized former Gov. Neil Goldschmidt’s sex with a 14 year old neighbor girl (when he was mayor of Portland 30 years ago) as an “affair”. Many cried “rape”, and the paper finally settled for “sex abuse.” Legally if he were caught in flagrante today it would be sex abuse with a prison sentence — even if the sex were consensual(statutory rape is no longer on the books & a 14 year old girl is not considered to be capable of consent).
A young womkan in Oregon is currently serving prison time for having sex with a 12 year old boy when she was 15 — a sentence not wanted by the “victim’s” mother, but demanded by a zealous DA.
Meanwhile gang rapists (alleged, of course) go free in California (rich kids, with connections) despite videotpaed evidence.
A judge on Monday declared a mistrial in Orange County’s high-profile gang-rape case after jurors lamented they were “hopelessly deadlocked” over charges that three young men victimized an apparently unconscious 16-year-old girl in a Newport Beach mansion.

And a woman gets convicted for “raping” a 15 year old boy.
